Why hasn’t this Mc Donald’s Sold? | Great demographics and strong cap rate don’t matter sometimes. ************************************************************************************************************ This Mc Donald’s in a high-income neighborhood in Nashville should have sold the first few days it was on the market to a 1031 exchange buyer. The demographics and aggressive cap rate should have been all you could ever ask for but for one clause in the lease. ROFR (right of first refusal) kills these deals 9 times out of ten and that’s what I personally think is going on here. In this case the tenant has 30 days to decide if they want to buy the property, putting the typical 1031 buyer in jeopardy of not being able to close on his up leg and thus blowing up his exchange. With this particular deal, I think the price point being close to land value may actually cause the tenant to actually execute the ROFR and buy the property. All you will be doing making on offer on this deal is forcing the situation with the tenant. I grade this deal a B+ and would offer a 5% cap rate based on the ROFR and t and the liquidity issue that runs with this lease.
